Drug Enforcement Admin., 357 F.3d 1012 (2004), a national association of companies that purchase and sell products containing sterilized hemp seeds and oil filed a petition for review, challenging the validity of the Drug Enforcement Agency (“DEA”) rule banning all naturally occurring THC, including the trace amounts found in hemp seeds and oils. There, the court cited the above quoted language from 21 U.S.C. 802(16) and held that placing non-psychoactive hemp finished products under Schedule I improperly renders naturally occurring non-psychoactive hemp illegal for the first time in
the nation’s history without any statutory support for doing so. The court held that the DEA “cannot regulate naturally occurring THC not contained with or derived from marijuana – i.e. non-psychoactive hemp products – because non-psychoactive hemp is not included in Schedule I. The DEA has no authority to regulate drugs that are not scheduled [emphasis added].” Id. at 1018. Accordingly, CBD hemp oil is not a scheduled substance under the CSA and its manufacture and sale are legal under the CSA.
